The man who claims to have taken over the counter Viagra in the UK has been charged with two counts of fraud in relation to the purchase of prescription drugs for erectile dysfunction, in relation to a drug containing the active ingredient sildenafil, which he says was prescribed for him.
The suit against Boots, Lloyds and its partner, will go to trial, said the suit, which was filed by a group of men who claim that they purchased Viagra after taking the drug.

Eli Lilly and Company said Tuesday that it will begin to promote the drug Viagra, which treats erectile dysfunction, by offering it to patients and doctors throughout the United States.
Lilly is the world's largest maker of erectile dysfunction medicines, with a market share of about 8 percent.
But Lilly said that Viagra, the world's top-selling prescription drug, will continue to be promoted to doctors and patients for at least a year.
"It's a huge market that we have in the United States and it's huge," said Mark McClellan, president of the American Association of Urologists, which represents the association.
McClellan said the company was pleased with the sales growth, saying it has seen first-quarter revenue grow 8 percent to more than $2 billion.
"We've seen some meaningful revenue growth from Viagra, but we believe that's going to be a very tough sell for Lilly, which has the highest revenue of any of our medicines," McClellan said.
Lilly also said Tuesday it is reviewing its Viagra marketing campaign.
In March, the drugmaker said it would begin marketing the pill in March.
McClellan said the company will have three days to submit an application to the U. S. Food and Drug Administration to market Viagra in the country.
Pfizer, the world's biggest drugmaker, will not make Viagra in the United States but will continue to market it to people in other countries.
Pfizer said Tuesday that the company will continue to promote Viagra to doctors throughout the world.
"We're very pleased to continue to promote Viagra to people in this country and around the world," Pfizer spokeswoman Jill Clayburn said in a statement.
